Welcome to Mianya’s Photography. These Terms of Service apply to photographs, videos, galleries, and other visual content made available through this website.
By viewing, downloading, purchasing, sharing, or otherwise using Content from this website, you agree to these terms.
Copyright & Ownership
All photographs, videos, motion content, graphics, and other creative work displayed or delivered through this website (collectively, “Content”) are protected by copyright and remain the intellectual property of Mianya’s Photography unless otherwise agreed to in writing.
Purchasing, downloading, receiving, viewing, or being given access to Content does not transfer copyright ownership.
How You May Use Content
Your right to use Content depends on the license associated with your gallery, purchase, photography or video assignment, or written agreement with Mianya’s Photography.
Content provided for personal use may be downloaded and shared for personal, non-commercial purposes, including personal social media.
Clients, businesses, teams, athletes, organizations, and other parties working with Mianya’s Photography may have additional usage rights established by their individual agreement or license.
Commercial Use
Content may not be used for advertising, paid campaigns, sponsorships, merchandise, product promotion, commercial publications, resale, or other commercial purposes unless those rights have been specifically granted.
Receiving Content from another person or organization does not automatically grant permission to use it commercially.
If you would like to use Mianya’s Photography Content commercially and your existing license does not cover that use, please contact us for licensing.
Social Media & Sharing
When your license permits social media use, Content may be posted and shared on social platforms. Credit to Mianya’s Photography is appreciated whenever practical.
Normal social media adjustments, such as cropping, resizing, or changing the aspect ratio to fit a platform, are permitted.
Content may not be substantially altered, have watermarks or identifying marks removed, or be represented as the work of another photographer, videographer, or creator.
Video Content
Video and motion content may be used according to the license associated with the project, purchase, or gallery.
Unless specifically authorized, videos may not be resold, sublicensed, substantially re-edited into another commercial production, or provided to third parties for unauthorized commercial use.
Individual clips, still frames, or other elements extracted from a video remain protected by copyright and are subject to the same licensing restrictions as the original Content.
Digital Purchases & Downloads
Digital purchases are final once the Content has been delivered or made available for download.
Purchasing digital Content provides a license to use it according to the terms associated with the purchase. Copyright remains with Mianya’s Photography.
Screenshots, screen recordings, or other methods of capturing Content from a gallery do not constitute a purchase and do not grant permission or a license to use the Content.
Purchased or downloaded files may not be resold, sublicensed, redistributed as downloadable files, or made available for others to download unless specifically authorized.
Screenshots & Unauthorized Gallery Captures
Content displayed within a gallery remains protected by copyright regardless of whether downloading has been enabled.
Taking screenshots, screen recordings, or otherwise capturing Content for the purpose of avoiding a purchase or download requirement is not permitted.
Posting, publishing, reproducing, distributing, or commercially using Content captured from a gallery without authorization is prohibited.
Removing or cropping out a watermark, copyright notice, logo, or other identifying mark does not grant permission to use the Content.
Prints & Physical Products
Minor differences in color, brightness, cropping, or appearance may occur between digital displays and printed products.
If a physical product arrives damaged or has a manufacturing defect, please contact Mianya’s Photography promptly so the issue can be reviewed and, when appropriate, corrected or replaced.
Gallery Availability
Online galleries are provided for viewing, selection, purchasing, and delivery. They are not intended to serve as permanent storage or archival services.
Galleries may expire, be archived, or be removed after their stated availability period.
Clients and purchasers are responsible for downloading and safely storing their delivered or purchased files before a gallery expires.
Mianya’s Photography cannot guarantee indefinite online access to previously delivered Content.
Unauthorized Use
Unless specifically permitted by your license or written agreement, Content may not be copied, reproduced, resold, redistributed, sublicensed, commercially exploited, or provided to third parties for unauthorized use.
Content may not be used to train artificial intelligence systems or incorporated into machine-learning datasets without prior written permission from Mianya’s Photography.
Unauthorized use may result in additional licensing fees and/or enforcement of Mianya’s Photography’s intellectual property rights.
Client Agreements
These Terms of Service provide the general rules for using this website, its galleries, purchases, and the Content available through them.
Clients who have entered into a separate written agreement with Mianya’s Photography may have different or additional rights and responsibilities.
If a signed client agreement provides specific usage rights that differ from these general Terms, the signed agreement will control for that project.
Third-Party Services
This website may use third-party providers for gallery hosting, payment processing, printing, fulfillment, or other services. Those services may also be subject to the respective provider’s terms and policies.
Updates to These Terms
Mianya’s Photography may update these Terms of Service as our services and business practices evolve.
Changes to these general website Terms do not override usage rights previously granted through a separate written agreement.
